What other bodies does a foundation have?

The donor may provide for further bodies, in particular to select a beneficiary from the group of beneficiaries, to determine the time, amount and conditions of a distribution, to administer the assets, to advise and support the foundation board, to supervise the administration of the foundation with regard to the fulfilment of its purpose, to reserve the right to approve or issue instructions and to protect the interests of the foundation’s participants. These bodies do not have the power of representation.

The board of a foundation may also establish other bodies if the donor has granted this right in the statutes and it is objectively justified.

Other possible governing bodies are the legal representative, who has the power to represent the foundation before public authorities and acts as the receiving agent, a family council, an asset management body, and an advisor or protector.
