What does lending mean?

Lending means that users transfer their tokens to others for a certain period and at an agreed interest rate. By regulating the custody and the statutory regulations on the separation of tokens in the event of bankruptcy, the TVTG has created a situation that is analogous to securities. Since tokens can also be structured to resemble payment methods i.e. fungible, a special situation arises in the event of token lending in combination with irregular custody: When customers transfer tokens to a company to be held in irregular custody and thus to the property (i.e. to the balance sheet) of the company, a repayment obligation arises that can be nominated in the unit of this token. If this company then loans out the tokens transferred by the customer, this results in a constellation analogous to the balance sheet transactions of a bank, whereby the Banking Act is not applicable in this case.
