What duties does the foundation board have in Liechtenstein?

Share

From the time of its establishment, the foundation board is the supreme governing body of the foundation. The foundation board manages the business of the foundation and represents it externally. It is responsible for fulfilling the purpose of the foundation in accordance with the provisions of the foundation documents.
A foundation is designed to carry out the purpose specified by the donor over the long term, and the foundation board must respect the donor’s wishes in managing the foundation and making distributions to beneficiaries.
The foundation board consists of at least two members, who may be natural or legal persons, domestic or foreign, and resident in Liechtenstein or abroad. The donor or beneficiaries may also be members of the foundation board. The foundation board must include a lawyer or a trustee licensed in Liechtenstein (a so-called person according to § 180 a PGR). This person is personally liable for compliance with legal requirements, in particular compliance requirements, the observance of tax obligations and reporting requirements, such as those arising from the international agreements on the exchange of tax information.
